The following Terms and Conditions of Use ("Terms") are entered into by and between You ("User," "Client") and Soulful Breaths ("Company," "we," "our," or "us").

These Terms, together with our Privacy Policy, Disclaimer, and any other documents expressly incorporated by reference, govern your use of the website www.soulfulbreaths.com and any subdomains ("Website"), including all materials, resources, information, and services provided on or through the Website, whether as a guest or registered user.

Your access to and use of the Website is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, customers, and others who access or use the Website and/or services.

By accessing or using the Website, you agree to be bound by these Terms without modification and acknowledge that you have read them. If you disagree with any part of these Terms, please do not access or use this Website or our services.

1. Services

Soulful Breaths provides breathwork, wellness sessions, workshops, retreats, corporate wellness programs, speaking engagements, and collaborations. These services are complementary wellness practices and do not constitute medical or psychological advice.

2. Consent and Assumption of Risk

By participating in services:

  • You voluntarily assume all risks associated with breathwork.

  • You confirm you have consulted with a healthcare provider if you have medical conditions such as cardiovascular disease, pregnancy, severe mental health disorders, epilepsy, or recent surgeries.

  • You release Kristine Rafanan and Soulful Breaths from liability for any personal injury or outcomes resulting from participation.

3. Collaboration and Business Partners

Soulful Breaths partners with gyms, wellness studios, wellness facilitators, retreat facilitators, and corporate teams.

  • Collaborations are subject to separate written agreements detailing responsibilities, fees, liability, and confidentiality.

  • All partners agree to honour participant privacy and comply with applicable laws.

4. Booking & Payment

  • All sessions must be booked in advance.

  • Payment is required before or at the time of service.

  • Cancellations must be made at least 24-48 hours in advance to avoid fees.

5. Cancellation, Rescheduling & Refund Policy

Soulful Breaths operates as a capacity-based wellness practice. Because availability is intentionally limited, all bookings reserve time and energetic capacity that cannot be reallocated once purchased.

By purchasing any session, package, workshop, event, or group experience, you acknowledge and agree to the Cancellation, Rescheduling & Refund Policy, which is incorporated into these Terms by reference and available in full on our website.

In summary:

• Session packages are non-refundable
• Unused sessions do not expire but are not redeemable for cash
• Single sessions require at least 24 hours’ notice to reschedule
• Workshops, events, and group experiences are non-refundable
• Cancellations within 48 hours of a workshop or event are not eligible for refund or transfer
• Chargebacks are not permitted for services rendered or time reserved

Soulful Breaths reserves the right to decline refunds in all circumstances outlined in the full policy under FAQ.

6. User Responsibilities

  • You agree to provide accurate information when booking sessions and when filling intake forms.

  • You acknowledge that breathwork may evoke emotional or physical responses, and participation is at your own discretion.

7. Limitation of Liability

Soulful Breaths and Kristine Rafanan are not liable for any physical, mental, or emotional outcomes resulting from participation in breathwork sessions or the use of our website. Always consult with a healthcare professional before starting breathwork, especially if you have underlying health conditions.

8. Intellectual Property

All content on the website, including materials, logos, videos, and course content, is owned by Soulful Breaths and cannot be copied, used or distributed without permission.

9. Governing Law

These Terms are governed by the laws of Ontario, Canada, and any disputes will be resolved under Canadian jurisdiction.
